End User License Agreement

The licence Neurolith grants you to use its website, Discord application and Calls, and what that licence does not allow.

1Agreement

1.1 This End User License Agreement (the “EULA”) is between you and the founders who operate Neurolith (“Neurolith”, “we” or “us”) and forms part of the Terms of Service. Capitalised terms not defined here have the meaning given in the Terms. By accessing or using the Service, you agree to this EULA.

2Licence Grant

2.1 Subject to your continued compliance with the Terms and this EULA, we grant you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to access and use the Service, and to view, download and share the Calls produced for you, for your own personal, non-commercial purposes.

2.2 You may share a Call, a share picture or a link to a Call with others using the share features we provide, provided that you do not alter it, remove its disclaimer or attribution, or present it as personal or financial advice.

3Restrictions

3.1 Except as expressly allowed by the Terms or by mandatory law, you must not, and must not allow anyone else to:

  1. copy, modify, translate or create derivative works of the Service or any part of it;
  2. decompile, disassemble, reverse engineer or attempt to derive the source code, models, prompts, weights, rules or data of the Service;
  3. scrape, crawl, harvest or systematically extract Calls or other data from the Service, or use any automated means to access it, other than our official Discord application;
  4. use the Service or any Call to build, train, calibrate, benchmark or improve a competing product or any machine learning model;
  5. sell, resell, rent, lease, sublicense, publish as a feed or signal service, or otherwise commercially exploit the Service or Calls;
  6. remove, obscure or alter any proprietary notice, trade mark, disclaimer or attribution;
  7. circumvent any limit, access control or security measure; or
  8. use the Service in breach of the Acceptable Use Policy (part of the Terms of Service) or any applicable law.

4Ownership

4.1 The Service, including all software, models, methods, rules, data compilations, designs, text, graphics, trade marks and Calls, is and remains the property of Neurolith or its licensors. This EULA grants a licence; it does not transfer ownership of anything. All rights not expressly granted are reserved.

5Discord Application

5.1 Your use of the Neurolith Discord application is also subject to Discord’s own terms and policies. Discord is not a party to this EULA and is not responsible for the Neurolith application.

6Third-Party Components and Data

6.1 The Service uses data and components provided by third parties, including open-source software made available under its own licences. Those licences govern the relevant components, and nothing in this EULA limits your rights under them. Third-party data is provided without any warranty from us or from its providers.

7Updates

7.1 We may update the Service at any time, including to add, change or remove features. This EULA applies to every update unless an update comes with separate terms.

8Termination

8.1 This licence ends automatically if you breach the Terms or this EULA, or when your Account is terminated. On termination you must stop using the Service. Section 3, Section 4 and the disclaimers and limitations of liability in the Terms survive termination.

9Disclaimer and Liability

9.1 The Service and every Call are provided “as is” and “as available”. The disclaimers of warranties and the limitations of liability in the Terms apply fully to this EULA.
